Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that an employee was
exposed to serious injuries from falling
when they were lifted approximately fifteen feet on platforms that have no
guardrails and are not securely
attached to the forks of a powered industrial forklift:
(a) Facility, Munson Street, McKees Rocks, PA:  On or about November 29,
2006, an employee was
observed standing on a pallet that did not have any guardrails and was not
securely attached to the forks of a
powered industrial forklift.
Among other methods, one feasible and acceptable means of abatement is
that the employer must ensure that a
lifting platform, designed and approved for such use is secured to the
forks
of an industrial truck as per the
American National Standard Institute Safety Standard for Lowlift and
Highlift Trucks, ANSI/ASME B56.1 -
2000, Sections 7.36.1 and 7.36.3. All platforms must be in accordance with
the manufacturer's specifications.
