North Carolina General Statute 95.129(1) of the Occupational Safety
and Health Act of North Carolina: The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to being struck by/run over by motorized front end loader:
a)establishment, stock yard, Caterpillar Model 928G front
end loader, back up alarm - the back up alarm was
inoperable and employees working in and around the stock
yard were exposed to the hazard of being struck by/run
over prior to and on May 2nd, 2005.
Among other methods, one feasible and acceptable
abatement would be to establish a program requiring
operators to inspect motorized equipment before the start
of each shift for defects and remove defective equipment
from service until repaired.
