SCRR 71-112A: Failed to furnish a place of employment which is free of
recognized hazards
which may cause death or serious physical harm to his employees and comply
with this
regulation and other occupational safety and health rules and regulations
promulgated under
Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as
amended, as
follows:
A.  Employer knew or should have known that the operator of a Lull 644
TT34 Model
forklift, Identification Number 1026LN, not at the controls while one
employee was elevated
in a work basket, in excess of 11 feet high, at front of Piggly Wiggly
building, constituted a
hazard of the lift shifting or of the employee falling, or of the lift
being struck by objects or
other hazards and no way for the employee to get down.  A feasible and
useful method,
among others, to correct this hazard is to have the operator remain at the
controls while the
employee is in an elevated basket.
