Section 5(a)(1) of the Occupational Safety and Health Act of 1970:The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to being struck by motor vehicles
operating on the road:
One means of feasible abatement, among others, is to provide high
visibility clothing or vests as published in
the Millennium Edition of the Manual of Uniform Traffic Control Devices
MUTCD) of the Department of
Transportation or the American National Standards Institute (ANSI)
D6.1-1-1971.
OR IN THE ALTERNATIVE
29 CFR 1910.132(a): Protective equipment was not used when necessary
whenever hazards capable of causing
injury and impairment were encountered:
a) On Estero Blvd., in front of 5100 Estero blvd., Fort Myers Beach, FL
33931 - the employee
dressed, in dark coveralls, was on the traveled portion of the two lane
road (center) directing and
stopping motor vehicle traffic while another person was bringing the JLG
down the road and
positioning it for loading onto the trailer for transport in the south
bound lane. Employee was exposed
to the hazard of being struck by a vehicle traveling at speeds of 35 to 45
MPH. Traffic signs or traffic
cones, notifying the operators of the motor vehicles approaching the area,
were not in use, on or about
