Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and crushing injuries due to the rollover and/or collision of powered industrial trucks: Facility Wide - Seat belts were not worn by employees operating the Daewoo G25E forklift on even and uneven surfaces, traversing sloped terrain and over curbs. Seat belts are a component of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a rollover or collision. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all forklift operators wear seat belts.
