Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to the hazard of being struck-by a Ford front end loader in the event of a tip over. Among other methods, one feasible and acceptable method to correct this hazard is to require the employee to repair/replace faulty seatbelt and require employees to fasten the seatbelt in accordance with manufacturer's instructions.
