Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by a Terex Rough Terrain Forklift, model TH636C, in the event of a tip over. a) Among other methods, one feasible and acceptable method to correct this hazard is to ensure that the operator of the rough terrain forklift utilizes the seat belt provided by the manufacturer. Disclaimers: 1.You are not limited to the abatement methods suggested above. 2.The methods explained are general and may not be effective in all cases. 3.The employer is responsible for selecting and carrying out an appropriate method of abatement. INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, SECTION 5(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 307601625, CITATION NUMBER 1, ITEM NUMBER 1, ISSUED ON OCTOBER 7, 2005, WITH RESPECT TO A WORKPLACE LOCATED AT 9875 BLUEBONNET BLVD. BATON ROUGE, LA 70810. THIS CASE WAS CLOSED ON NOVEMBER 3, 2005.
