Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the recognized hazard of being crushed by the
Nissan Model 30
Powered Industrial Truck in the event of a turn over.
a)  Among other methods, one feasible and acceptable method to correct
this hazard is
to ensure that the operator of the powered industrial truck utilizes the
Operator Restraint
Device (seat belt) provided by the manufacturer in accordance with Section
7.41 of the
American National Standard developed by the Industrial Truck Standards
Development
Foundation (ITSDF) B56.1-2005, Safety Standard for Low Lift and High Lift
Trucks.
