Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being crushed by the Taylors Machine Works Big Rig powered industrial fork tractor in the event of a rollover. a) Throughout lumber yard; The seat belt was torn off of the seat of the Taylors Machine Works Big Rig diesel power industrial fork tractor (model 76825GM/Serial #S-C220741) used to ferry bundle of lumber and other wood products throughout the yard. Operators were exposed to the hazard of being injured by a potential roll-over. Among other methods, one feasible and acceptable method to correct this hazard would be to replace missing seat belts and to require that the operator of the powered lift tractor truck utilize the seat belt. DISCLAIMER 1. You are not limited to the abatement methods suggested above. 2. The methods explained are general and may not be effective in all cases. 3. The employer is responsible for selecting and carrying out an appropriate method of abatement.
