employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazards of being crushed by the Toyota #4 forklift truck in
the event of a tip
over.
Zone 6 of warehouse; A seat belt was not provided nor used by operators of
the Toyota
#4 powered industrial truck (Model 42-6FG6U25). Employees were exposed to
the
hazard of being crushed by potential roll-over action of the fork truck.
Among other methods, one feasible and acceptable method to correct this
hazard would
be to require that the operators of the powered industrial truck utilize
the
seat belt and
that missing seat belts be replaced.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish

exposed to serious body injuries in the event of a fall due to using a
lanyard with a broken self-
retracting device that will not arrest that fall as prescribed.
Warehouse; The retractable device was broken on the 7' long nylon lanyard
attached
to
the Miller 3" body belt provided to employees to arrest falls. The broken
device would
allow a free fall distance of 7' rather than an allowed maximum free fall
of 5'.
Employees were exposed to serious body injuries in the event of a fall.
Among other methods, one feasible and acceptable method to correct this
hazard would
be for the employer to comply with the requirements of the American
Society of
Mechanical Engineers Safety Standard For Low Lift And High Lift Trucks
(ASME
B56.1-2000) which states in part that "lanyards..length shall be such that
the
operator(s)..shall be limited to a maximum free-fall of 1,525 mm (5 ft)..
