Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being crushed by the Champ powered industrial fork truck in the event of a rollover. a) Throughout the plant and the yard; The seat belt was missing from the Champ 3560005 diesel powered industrial fork truck being used to unload iron from trucks and to transport metal throughout plant. Operators were exposed to the hazard of being injured by a potential roll-over. Among other methods, one feasible and acceptable method to correct this hazard would be to replace missing seat belts and to require that the operator of the powered lift tractor truck utilize the seat belt. DISCLAIMER 1. You are not limited to the abatement methods suggested above. 2. The methods explained are general and may not be effective in all cases. 3. The employer is responsible for selecting and carrying out an appropriate method of abatement.
