Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck-by falling material
or equipment:
For the period of time up to and including March 22, 2006, the employer
did not ensure that
employee(s) engaged in the dismantling of large pieces of equipment were
protected
from falling
or collapsing material and equipment.
Among other methods, feasible and acceptable methods to correct this
hazard would be to:
1.Pre-plan work involving heavy upright material that could pose a
struck-by hazard.
2. Ensure the use of temporary supports or other protective devices where
needed to prevent
unintended or premature collapse of the material being salvaged.
3. Develop and implement safe work practices that address methods to
stabilize large
unstable material and equipment.
4. Train employees regarding the use of temporary supports and safe work
practices for
working with large unstable material and equipment.
