Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that the employee was
exposed to the hazard of being crushed by the Hyster #6328 electric
forklift truck in the event
of a tip over.
Body shop 355; The seat belt was not being used by operator of the Hyster
#6328
electric powered industrial truck. The employee was exposed to the hazard
of being
crushed by potential roll-over action of the fork truck.
Among other methods, one feasible and acceptable method to correct this
hazard would
be to fix the broken belt and to require that the operator of the powered
industrial
truck
not use the truck when the belt is broken or defective.
