General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to the hazard of being crushed by the Hyster 60 and 8,000 lb. powered industrial forklift trucks in the event of a tip over accident. In front of the lumber building; Seat belts were not being used by operators of the Hyster 60 and the 8,000 lb. powered industrial trucks that were being used in front of the lumber building to load and unload products. The employees were exposed to the hazards of being crushed by potential roll-over action of the fork trucks. Among other methods, one feasible and acceptable method to correct this hazard would be to enforce the requirement that the operators of the powered industrial trucks use the seat belts provided. The employer is responsible for selecting and carrying out an appropriate method of abatement.
