5(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by falling steel storage racks, and/or the components of the steel storage racks, including materials stored on the racks. The commercial steel storage racks, located in the warehouse production area, company identifier P01, P03, P05 and P06 had the end vertical support posts damaged by powered industrial trucks to the extent some were completely broken away from their floor mounting. The racks were buckling and leaning and were in imminent danger of collapse. Possible means of abatement include, replacing and repairing the vertical support posts and following the recommendations listed in the American National Standards Institute (ANSI MH16.2- 1984) (R1996) titled "For the Use of Industrial and Commercial Steel Storage Racks - Manual of Safety Practices / A Code of Safety Practices" Section 1, Paragraph 1.3 Collision Protection; Section 3, Paragraph 3.11 Damaged Racks; Section 4, Paragraph 4.1 Inspection Program; and Paragraph 4.2 The Damaged, Dented, Buckled, or Bent Rack.
