Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a.United Bank, Atmore, Alabama: On Wednesday, October 12, 2005, an employee was operating a Lull industrial forklift and was not wearing the seat belt. The seat belt had been installed by the manufacturer and the Lull was provided with a Roll Over Protection System (ROPS). The Lull tilted and the driver jumped out instead of remaining seated with the seat belt on, thus exposing himself to crushing hazards by the tilting forklift. Among other methods, one feasible and acceptable method for the employer to abate this hazard is by complying with the manufacturer's recommendation as stated in the (Lull's) owner's manual and ensure that the operator's fasten the seat belt when operating the Lull.ting
