North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)Site - - An employee was lowered into a trench excavation while standing on a load suspended from the bucket of a Caterpillar 322 C track excavator and was lifted from the excavation while standing on the bucket of the track excavator. REFERENCE:Operation and Maintenance Manual - Caterpillar 322 C Excavator, Caterpillar, Inc.: Before Starting Engine Section: "Before you start the engine and before you move the machine, make sure that no one is underneath the machine, around the machine, or on the machine. Make sure the area is free of personnel." Before Operation Section: "Clear all personnel from the machine and from the area." Operation Section - Machine Operation: "Make sure that no personnel will be endangered before you move the machine. Do not allow riders on the machine unless the machine has an additional seat with a seat belt." NOTE:Among other methods, one feasible and acceptable method to correct this hazard is to provide a ladder or other safe means of access to and egress from any trench that is four feet or more in depth and to establish a work rule that prohibits employees from riding on suspended loads or in the buckets of material handling machinery.
