North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment
and a place of employment which were free from recognized hazards that
were causing or
likely to cause death or serious harm to employees:
a)Facility - - The employer did not ensure that the bottom-running, one-ton
Wright-Airway air-powered chain hoist was inspected as required.

Chapter 16-2 - Inspection, Testing, and Maintenance:
Section 16-2.1.1 - Inspection Classification:
b)1)Frequent Inspetion:  Visual examinations by the
operator or other designated person with records
not reequired.
a)Normal Service:  monthly.
b)Heavy Service:  weekly to monthly.
c)Severe Service:  daily to weekly.
2)Period Inspection:  Visual inspection by a
designated person who makes records of external
conditions to provide the basis fro a continuing
evaluation:
a)Normal Service:  yearly.
b)Heavy Service:  semi-annually.
c)Severe Service:  quarterly.
Section 16-2.1.2 - Frequent Inspections:
c)2)Hoist upper limit device of electric- or air-
powered hoists, without a load on the hook, [shall
be inspected] at the beginning or each shift.
NOTE:Among other methods, one feasible and acceptable method to correct
this hazard is to initiate an inspection procedure for the Wright-Airway
chain hoist that insures required inspections of the hoist covering the
items listed in B30.16 - Chapter 2 are performed by competent
personnel in compliance with the schedules contained in the Chapter.

a)Facility - - The rated load of the Wright-Airway chain hoist was not
marked
on the hoist or the load block such that the marking was clearly visible
from
the floor.

Chapter 16-1 - Marking, Construction, and Installation:
Section 1.1.1 - Rated Load.  The rated load of the hoist shall be
marked on the hoist or its load block and shall be legible from
the ground or floor.
NOTE:Among other methods, one feasible and acceptable method to correct
this hazard is to clearly mark the rated load capacity of the hoist on the
hoist or its load block so that the load capacity is legible from the
floor.

a)Service Department - - The load hook on the Wright-Airway chain hoist
did not have a safety
latch.

Section 10-1.2.1.3 - Periodic Inspections:
(c) Hooks having any of the following conditions shall be removed from
service until repaired or replaced.
(5)Inoperative Latch.  Any latch that does not close the hook's
throat.
NOTE:Among other methods, one feasible and acceptable method to correct
this hazard is to
install a properly sized safety latch on the load hook for the
Wright-Airway chain hoist.
