Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: On or about July 29, 2005 at the Forrest City Community Center in Forrest City, AR: The following fall hazard was observed: Employees were exposed to fall hazards, while working from and as passengers on a personnel platform being lifted by a Caterpillar Model TH83 rough terrain forklift. The employees were not wearing personal fall protection at a height of approximately 13.5 feet above the ground. Feasible and acceptable methods include but are not limited to the following: Employers should reference the ANSI B56.5 Rough Terrain Fork Lift Trucks. In accordance, with this standard employees are required to use a full body harness and lanyard anchored to the personnel platform. On or about July 29, 2005 at the work-site located at the Forrest City Community Center in Forrest City, AR employees were exposed to falls while working from and as passengers on a personnel platform being lifted by a Caterpillar Model TH83 rough terrain forklift. The employees were not wearing personal fall protection at a height of approximately 13.5 feet above the ground.
