Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling/crushing injuries from an aerial lift overturning, due to the fact that the operator did not heed the 5 degree tilt warning light provided on the Model 400S JLG lift. Among other methods, one feasible and acceptable method to correct this hazard is to require and effectively enforce the heeding of the alarm and operational direction provided by the manufacturer by repositioning the lift to a more level surface. On or about August 23, 2005 at the worksite located at Hwy 65 South in Dumas, Arkansas an employee was exposed to falling/crushing injuries from an aerial lift overturning, due to the fact that the operator did not heed the 5 degree tilt warning light provided on the Model 400S JLG lift and reposition the lift to a more level surface.on
