a) Location:795 Commerce Parkway in Venice Fl. An employee was exposed while traveling on Commerce Parkway entering into the construction sit (795 Commerce). Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling off and being run over by a back hoe/front end loader (John Deere 310G 24991 Back Hoe) while riding on the step of the machine. One feasible and acceptable abatement method to correct this hazard is to prohibit any employee from standing or sitting on the equipment, other than approved passenger seats, while the equipment is in motion or operation. The National Safety Council Publication; Data Sheet I-589, copyright 1977, "Front End Loaders" prohibits passengers from riding on equipment. The John Deere Operator's Manual 310G and 3155G Backhoe Loaders (OMT191038 Issue A4) specifically states "KEEP RIDERS OFF" "Only allow the operator on the machine. Keep riders Off." (pg 1-3-3). The Safety Manual # 19 states " WARNING! YOUR BACKHOE/LOADER IS A ONE PERSON MACHINE. NEVER PERMIT RIDERS." Violation was observed on or about 5/23/06
