North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that the employee was exposed to, among others, the hazard of
contact with electrical energy
(overhead power transmission lines) :
a)on or about 3:15 PM, 8/26/05, the employer allowed an employee who had
not completed
aerial lift training to operate a scissor lift.   The employee elevated
the platform into overhead
electrical transmission lines and was exposed to electrical shock.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to ensure that only employees who have successively completed aerial lift
training be allowed
to operate the scissor lift.
