North Carolina General Stature 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that a chain saw was in use without adequate safety devices: a)facility, an employee was observed using a Husquvarna chainsaw that was missing the chain break and chain catch. Among other methods, one feasible and acceptable method to correct this hazard includes, but is not limited to ensuring that chainsaw is removed from service until it has been repaired.
