North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential fall of over 8 feet while on top of raised forks of a forklift: a)facility, on December 7, 2005, an employee was observed standing on the elevated forks of a Yale forklift dumping waste wood product into dumpster. Among other methods, some feasible and acceptable abatement methods are: 1. Obtain a proper manlift for employees to access the dumpster with the forklift. 2. Obtain and utilize self dumping trash bins specifically designed for forklift use.
