Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to the hazard of driving a fork
truck off the end of a tractor trailer while loading or unloading
merchandise to/from the truck:
a.The employer did not adequately ensure that all fork trucks were off of
the trailer before the trailer
was moved away from dock 63.
On November 21, 2005, a tractor trailer was moved away from the dock
before a fork lift truck had
fully exited the trailer and the fork truck fell to the pavement below.
Among other methods, feasible and acceptable methods to correct this
hazard include, but are not
limited to the following:
a.Install CB radio communication between the Spotter, the Controller, the
driver
of the
fork truck and the driver of the trailer.
b.Require the Spotter to visually check the truck before authorization to
pull the trailer
away from the dock.
c.Raise the dock plate up to signal to all employees involved that the
truck is empty of all
vehicles and is ready to pull away from the dock.
d.Require the Controller to visually check the trailer before authorizing
the trailer to move
away from the dock.
e.Add to the Spotter form a place for initials certifying that the trailer
is ready to leave the
dock.
f.Install Dock Locks on the docks in the West Warehouse to ensure that
trucks dont leave
the dock until it is safe.
