Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a. On the site, the employer did not ensure a safety pallet designed for lifting personnel was used on the forks of a Skytrak Rough Terrain Forklift. The employee was standing on a pallet which was slid onto the forks, not secured and not designed for use by personnel in order to gain access to the roof area. Among the feasible means of abatement that can be used to correct this are: Utilize only platforms designed for use in elevating personnel with forklifts. These must meet the requirement set forth in ANSI/ASME B56.6-2002.
