Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a.At the site where employees were cleaning the ceiling and overhead door tracks from a Genie GS 1930 scissors lift, SN# 31705, that was positioned between the tracks of a 16X16 foot garage door, employees were exposed to a struck-by hazard when the door was not locked in the down position nor other means provided to protect employees in the scissor lift from the overhead garage door. On or about 03/08/06, the overhead door was opened and struck the scissors lift knocking it over injuring the employees working in the lift. Among the feasible means of abatement that can be used to correct this are: a.Comply with the provisions of ANSI/SIA A92.6-1999, American National Standard for Self-Propelled Elevating Work Platforms, section 8, Responsibilities of Operator, paragraph 8.7, Workplace Inspections, which states "before the aerial platform is used and during use, the operator shall check the area in which the aerial platform is to be used for possible hazards." b.Comply with the provisions of ANSI/SIA A92.6-1999, American National Standard for Self-Propelled Elevating Work Platforms, section 8, Responsibilities of Operator, paragraph 8.10, Operator Warnings and Instructions, (10), which states that "When other moving equipment and vehicles are present, special precautions shall be taken to comply with local ordinances or safety standards established for the workplace. Warnings such as, but not limited to, flags, roped off areas, flashing lights, and barricades shall be used as appropriate."
