Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a.At the workplace, the Toyota electric forklift (Model: 7FBEU15; S/N: 10850) with a wooden pallet that was not secured to the forks was used to lift employees to perform various job tasks in the ceiling area of the facility, thereby exposing employees to a fall hazard of 15 to 20 feet. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not limited to, the following: Ensure that the provisions of ASME B56.1-2004 (or ASME B56.1-2000), Safety Standard for Low Lift and High Lift Trucks, Section 4.17 Elevating Personnel, are complied with for the protection of personnel lifted on forklifts.
