Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a.At the workplace, the Clark battery-powered forklift (Model: TM15; SN: TM2474138845) with a plastic pallet that was not secured to the forks was being used to lift employees (who were not wearing/using fall protection) so that they could access the excess stock that was stored on the top shelves of the storage racks in the warehouse. Employees were exposed to at least a 20 foot fall hazard. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not limited to the following: Ensure that the provisions of ASME B56.1-2004 ( or ASME B56.1-2000), Safety Standard for Low Lift and High Lift Trucks, Section 4.17 Elevating Personnel, are complied with for the protection of personnel lifted on forklifts.
