Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed: a) On August 7, 2005, employees were exposed to injuries while operating a Tampo, SP 518 Self Propelled Pneumatic Tired Roller without a rollover protection structure (ROPS) on gravel roads with steep embankments. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a ROPS available for this roller, and to install ROPS on any other similar equipment. Further, each project should be inspected for slopes or embankments and where they are present only equipment with ROPS should be used in such locations. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
