Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries: a) On August 10, 2005, and at times prior, employees involved in the installation of water sprinklers were exposed to injuries where they operated an Volvo EC20B that was equipped with rollover protection and were not wearing their seat belts. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the operator manual under "Safety of Operator," Page Number 6, Bullet 6, where it states to "always wear your seat belt." Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
