Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to being struck by vehicle. Employees were installing concrete forms employees were not wearing reflective vests and there were no road signs to reduce vehicle velocity while working: a) On or about May 18, 2006, at 7820 Hwy 50, Salida, CO, the employer did not ensure that reflective vest and signs were provided and used by employees exposed to struck by hazards while walking and working in the roadway. Among other methods, one feasible and acceptable method to correct this hazard is to employees wearing reflective vest and install signage according the MUTCD code. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
