Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employee were exposed to being struck by vehicle or equipment while working in live lanes of traffic without using reflective vests: a) On or about October 2, 2006 at 4th Street, Monte Vista, CO., Cooley & Sons Excavation, Inc., employees were exposed to being struck by vehicle or equipment while working in live lanes of traffic without using reflective vests. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to train and instruct employees to wear reflective vests while in a work zone. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
