29 CFR 1910.132(a):  Protective equipment was not used when necessary
whenever hazards
capable of causing injury and impairment were encountered:
a)On or about March 10, 2007, and at times prior, employees working at
heights were
not protected from falls while working on top of hay bales.
OR IN THE ALTERNATIVE
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which was free from
recognized hazards
which were likely to cause death or serious physical harm to employees in
that, employees
were exposed to a fall hazards in excess of 4 feet while loading and
unloading bales of hay:
a)On or about March 10, 2007, and at times prior, employees were exposed
to falls
from stacks of hay bales that exceeded 4 feet in height when unloading
hay.
Among other methods, one feasible and acceptable abatement method to
correct this
hazardous condition would be to install a fall protection system to be
used when employees
must work at heights greater than 4 feet.

this item
