Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: employees were exposed to being struck-by a dump truck backing up to an asphalt paver. a) West main street in Johnstown, New York, on or about 11-4-2005, an employee was backed over by a 2005 Mack brand dump truck, license plate # 26475TR, loaded with Asphalt that was backing up to the paver. Feasible and acceptable abatement methods are: All workers or other personnel shall keep clear of the rear of backing vehicles by a guide.
