Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)On or about December 22, 2005, at Washburn's Diary Inc, employees working adjacent to the machine room were exposed to potential releases of anhydrous ammonia from the refrigeration system used in the plant. Feasible methods of abatement include, but are not limited to, adherence to the safe design and operation of ammonia refrigeration systems as prescribed by the ANSI/ASHRAE 15- 1994, Safety Code for Mechanical Refrigeration section 8.13.2, which includes but is not limited to the following: 1.Each machinery room shall be equipped with a detector, placed in an area where ammonia will concentrate, which activates an alarm and the exhaust fans at a concentration not exceeding the TLV (PEL of 50 ppm). (b)On or about December 19, 2005, at Washburn's Diary Inc, employees were exposed to potential releases of anhydrous ammonia from the refrigeration system used in the plant. Feasible methods of abatement include, but are not limited to, adherence to the inspection and maintenance of ammonia mechanical refrigeration systems as prescribed by the International Institute of Ammonia Refrigeration Guidelines for: Start-up, Inspection and Maintenance of Ammonia Mechanical Refrigerating Systems section 6.7.1 and 6.7.2, which includes but is not limited to the following: 1.All uninsulated piping and components such as flanges and supports shall be inspected annually for damage or deterioration of the piping or protective finish. Remedial actions shall be taken when necessary. 2.Annually, the external condition of the insulation around piping and the supports shall be inspected. Sections of insulation which are in poor repair shall be removed and the integrity of the exposed piping evaluated with the aid of non-destructive testing techniques. Piping shall be replaced as necessary and re-insulated. ABATEMENT CERTIFICATION AND DOCUMENTATION IS REQUIRED.
