KRS 338.031(1)(a): The employer did not furnish employment and a place of
employment
which were free from recognized hazards that were causing or likely to
cause death or
serious physical harm to an employee in that:
a)For the mill operators of Shamrock Technologies who exposed to fire
and/or
explosion due to the presence of explosive dust along with malfunctioning
pressure relief rupture disk, which did not activated to release built up
pressure in the mill #3.  Housekeeping audits were done on a quarterly
basis
once every three months, which allowed various accumulations of explosive
dust to exist throughout the building.  The cleaning frequency was not
adequate to keep dust levels to a safe level.  These events contributed to
an
explosion which injured the mill # 3 operator.  Among other methods, one
feasible and acceptable abatement method to correct this hazard is to
establish
and enforce inspection, testing, and maintenance program such as that
stipulated by the National Fire Protection Association (NFPA 654 Standard
for
the prevention of Fire and Dust Explosions from the Manufacturing,
Processing, and Handling of Combustible Particulate Solids manufacturing,
Processing, and Handling of Combustible Particulate Solids 2000 Edition)
sections 8.1.1,8.1.2, and 8.1.3 Essential elements of the inspection,
testing ,
and maintenance program includes:
1.   Fire and explosion protection and prevention equipment in accordance
with the
applicable NFPA standards
2.Dust control equipment
3.Housekeeping
4.Potential ignition sources
5.Electrical, process, and mechanical equipment, including process
interlocks
6.Process changes
