Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple injuries or death from a falling hazard when using a Sponco Model 55, truck mounted boom supported platform: At the site, the platform was not used in accordance with the acceptable requirements of the manufacturer: On or about December 6, 2005 at the work-site located at Hwy 65 S in Dumas, Arkansas an employee was working from the basket of a Sponco, Model 55, truck- mounted boom supported platform at elevations of approximately 16 feet without the safety mechanism being engaged that prevents the ladder/platform from uncontrollably telescoping downward should the ladder winch line break.
