T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees: In that the employer did not ensure a place of employment free from hazards due to the potential tip over hazard and the forklift had an inoperable seatbelt. One possible abatement method would be to install an operable seatbelt that is approved by the manufacturer.
