Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crushing hazard in the event a fork-lift would tip-over.
:
On 12/2/05, two sit-down electric type fork-truck operators were observed
operating their truck
without using seat-belts.  Both of these trucks had seat belts installed
on them.
While ultimate responsibility for correcting the hazard rests with the
employer, given his/her
superior knowledge of the work place, feasible and acceptable methods to
correct this hazard,
among others are:
1) Follow the guidelines listed in the American Society of Mechanical
Engineers (ASME) B56.1-
2000, Safety Standard For Low Lift and High Lift Trucks, section 5.3.19.
2) Re-train all fork-lift operators on the hazards associated with
fork-lift tip-overs and how
wearing seat-belts is likely to prevent serious injury or death.
3) Actively enforce the wearing of seat-belts when operating fork-lifts
through a progressive
disciplinary policy.
