Section 5(a)(1) of the Occupational Safety and health Act of
1970:  The employer did not furnish employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees where exposed to fall hazards from a
moving vehicle:
On or about 09/02/05:
a) Roadway, Carlton Ave. and Wessix Place, Marlton N.J. -
Employees (laborers) permitted to ride on unintended riding
areas such as but not limited to, the exterior of the cab on
the drivers-side of a moving Crane Carrier Co. Model LET2
refuse/recycling truck, were exposed to fall hazards.
Among others, reasonable and useful methods to abate the hazard
would be to develop and implement a policy that follows the
requirements outlined in the American National Standard
Institute's standard for "Mobile Wastes and Recyclable Materials
Collection, Transportation, and Compaction Equipment - Safety
Requirements" (ANSI Z245-1-1999) and in the Crane Carrier Co.
Operation Manual. These requirements include but are not limited
to:
a) "Riding only in the cab, except where riding steps are
provided, and not riding anywhere else on the vehicle."
b) "Do not stand on the steps or any other part of the vehicle
while it is in motion.  The steps are for entering/exiting the
vehicle and not for riding on.  Failure to heed this warning may
result in serious personal injury or death".
NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS
REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE
TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN
ACCORDANCE WITH 29 CFR 1903.19.
