Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to being caught between the boom
of a backhoe and
the wall of the building:
(a) On or about December 20, 2005 - A guardrail and warning sign were not
installed
next to the operating backhoe boom on the south side of the building.
One suitable means of abatement is to comply with the operators manual of
the
equipment and barricade the danger area of the operating backhoe's boom.
