Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to crushing and other hazards
associated with
employees not being restrained in the forklift in case of tipping or a
rollover:
(a) Throughout yard and inside buildings, On or about 5/24/06 - Two
employees,
operating Thompson Caterpillar forklifts, were not wearing seatbelts while
operating the
lifts to pick up and transport recycled metal throughout the yard and
buildings.  Hazard
of crushing or rollover.
Among other abatement methods, one feasible and acceptable method to
correct the
hazard is:
To retrain employees regarding the importance of wearing seatbelts
provided and
by enforcing the policy that seatbelts must be worn each time the
forklifts are
used.
