Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to falling and crushing hazards
from forklift
operators not using the supplied seatbelts:
(a) Yard - Employees were operating powered industrial trucks without
using the
seatbelts that were supplied with the vehicle. This condition created a
crushed by
hazard to forklift operators.
Among other methods of abatement, one feasible and acceptable method to
correct this hazard is to prohibit employees from operating this type of
equipment without wearing seatbelts (as furnished by mfg.) and then
enforcing this prohibition.
