Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Academy Park Subdivision, on or about August 8, 2006 - An employee was struck by the boom of a backhoe while standing within the swing pivot area of a backhoe during active excavation operations. Among other methods, feasible abatement methods include: Adhering to the warnings in the backhoe manufacture's and the Equipment Manufactures Institute operator's and safety manuals by ensuring that no one is allowed to enter the backhoe swing pivot area while the backhoe is in operation. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
