A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that, the employer and/or designated representative did not prevent an employee from riding on the side of construction equipment (a Caterpillar backhoe) which had seating only for the operator in accordance with the manufacturer's recommendations and limitations. (a) 91st Avenue and Lower Buckeye, Tolleson, AZ. 85323: The employer and/or designated representative did not prevent an employee from sitting and riding on the side of construction equipment (a Caterpillar backhoe model number 420D serial number CRS17500) which was designed to accommodate the operator.
