Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to amputation and/or crushing injuries: a) HTC Maintenance Shear, Model P1MS3, where the foot pedal was not protected against unintended actuation; b) Century shear model 1010, SN 1C0056, where the foot pedal was not protected against unintended actuation. Among other methods, one feasible and acceptable means of abatement is to guard the foot pedal in accordance with ANSI (ASME) B11.4-2003, section 6.3.3.3(2).
