Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to fire and explosion hazards:
Employees accessing the company box-truck and walking into the north lot
were exposed to
fire and explosion hazards because the deflagration vent for the dust
collection system would
discharge into the lot and access is not restricted.  The dust collection
system handled
combustible dust from a rubber roller finishing process involving surface
grinding capable of
creating sparks and embers.
Among other methods, feasible and acceptable methods of abatement include
but are not
limited to relocating dust collection system to an unoccupied area or
barricading the area
around the dust collector to prevent unauthorized entry in accordance with
NFPA
68-2007
National Fire Protection Association, Standard on Explosion Protection by
Deflagration
Venting which states:
6.6.1  The material discharged from an enclosure during the venting of a
deflagration
shall be directed outside to a safe location.
