Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn and fall hazards: a) The portable ladder provided for employees to use for roof access and egress was approximately 7 feet from the roofing kettle. Among others, one feasible and acceptable means of abatement would be to ensure employee means of egress is no closer than 10 feet from the roofing kettle as required by the National Fire Protection Association's (NFPA), National Fire Codes (NFC), Chapter 9, Paragraph 9.1.2.8, Safeguarding Roofing Operations. No abatement certification or documentation required for this violation.
