North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: References: ANSI B30.16-1981, Section 16-2.1.3: Periodic Inspection - Complete inspections of the hoist shall be performed at intervals as defined in 16-2.1.1(b)(2), ANSI B30.16-1981, Section 16-2.2.2: Load test shall be performed as outlined in 16-2.2.2, for the employees who used in-house constructed lifting devices which were not load tested to determine their load capacity, and ASME B30.20A-2001, Section 20-1.2: Marking - The rated load of the lifting device shall be marked on the main structure where it is visible. a)maintenance loading area, northeast corner - for the employees who used an underhung hoist that had not been completely inspected. b)maintenance loading area, northeast corner - for the employees who used an underhung hoist that had not been load tested to determine its load capacity. c)maintenance loading area, northeast corner - for the employees who used in-house constructed lifting devices which were not marked with the rated load. d)stringer lamination area, northeast wall - for the employees who used an underhung hoist that had not been completely inspected. e)stringer lamination area, northeast wall - for the employees who used an underhung hoist that had not been load tested to determine its load capacity. f)stringer lamination area, northeast wall - for the employees who used an underhung hoist that had not been marked with its load capacity. g)stringer lamination area, northeast wall - for the employees who used in-house constructed lifting devices which were not marked with the rated load. One feasible abatement method to correct this hazard is to conduct load tests of the hoists and keep written records of frequent and periodic inspections of the hoists. Mark all hoists with the rated load. Additionally, conduct a load test on the lifting devices and mark the devices with the rated load.
